1. Accepting these terms
These Terms of Service ("Terms") are an agreement between you and the operator of TubeMake ("TubeMake", "we", "us") covering the TubeMake website, web application, desktop application and browser add-on (together, the "Service").
By creating an account or using the Service, you accept these Terms. If you do not agree with them, do not use the Service. If you are using TubeMake on behalf of a company, you confirm you are allowed to accept these Terms for that company.
You must be at least 16 years old, or the minimum age of digital consent where you live, whichever is higher.
2. What TubeMake is
TubeMake is a production tool for video creators. It helps you write a script, generate a voiceover, generate scene images and a thumbnail, and assemble a finished video file.
A significant part of that work runs on your own device — in particular the final video render, and optionally image generation through your own accounts. We do not host, publish, or distribute the videos you make, and we do not upload anything to YouTube on your behalf unless you explicitly connect your channel and ask us to.
TubeMake is not affiliated with, sponsored by, or endorsed by YouTube, Google, OpenAI, Meta, or any other platform mentioned in the Service. All trademarks belong to their respective owners.
3. Your account
- You are responsible for keeping your login credentials secure and for everything done through your account.
- One account is for one person or one business entity. Please do not share or resell account access.
- The information you give us must be accurate — particularly your email, because that is how we reach you about your plan and your payments.
- Tell us promptly if you believe your account has been accessed by someone else.
4. Plans and payment
TubeMake offers a free tier and paid plans. What each plan includes — video limits, credits and features — is shown in the app at the time you buy, and that display is what applies to your purchase.
How payment works
- The payment methods available to you are shown at checkout. We do not store card numbers, and there is no payment method kept on file.
- Nothing renews automatically. A plan runs for the period you paid for and then simply ends. To continue, you buy another period yourself. You will never be charged without doing so deliberately.
- Your plan activates once we have confirmed your payment. Payments are usually matched automatically within minutes; if yours is not, contact us with the payment reference.
- Prices are shown in US dollars (USD). Any fees or currency conversion charged by your own bank or payment provider are yours to pay.
Credits and premium voices
Some features — premium voiceover in particular — are metered separately from your plan and are consumed as you use them. Your remaining balance is always visible in the app. Credits have no cash value, cannot be exchanged for money, and cannot be transferred between accounts.
We may change our prices. A price change never affects a plan period you have already paid for; it applies to purchases you make after the change.
5. Refunds
Because the free tier lets you produce a real video before paying, we ask you to evaluate TubeMake there first, and paid purchases are generally final.
That said, we would rather have a fair reputation than one extra sale. If the Service is substantially broken for you, if you were charged in error, or if you paid for something you have not used, email us within 14 days of the payment and we will look at it in good faith. Refunds for consumed credits or for a plan period already largely used are not normally available. Refunds are made to the account the transfer came from.
6. Your content and your videos
What you provide
You keep ownership of everything you put into TubeMake — titles, scripts, images, character references, audio and any other material. By using the Service you grant us only the narrow permission needed to operate it: to store your material, and to transmit it to the AI providers required to fulfil the request you asked for. Nothing more. We do not use your content to train our own models, and we do not sell it.
You confirm you have the right to use everything you upload, including any image of a real person or any third-party material.
What comes out
The scripts, images, voiceovers, thumbnails and videos produced through TubeMake are yours. You may publish and monetise them commercially. We claim no ownership over them and no share of the revenue they earn.
Note that AI-generated material may not be eligible for copyright protection in every country, and that output from third-party AI providers is additionally subject to those providers' own terms. We cannot guarantee that any given output is unique or that a similar one has not been generated for someone else.
7. AI-generated output
TubeMake produces content using automated systems. That means output can be inaccurate, misleading, biased, or unsuitable for your purpose. It is a draft, not a fact.
- Review before you publish. You are the publisher of anything you upload, and you are responsible for it.
- Do not rely on generated content for medical, legal, financial or safety-critical claims without independent verification.
- You are responsible for complying with the rules of whatever platform you publish to — including YouTube's policies on disclosure, spam, repetitious content and monetisation. Meeting them is not something we can promise on your behalf.
8. Third-party accounts and your own API keys
TubeMake can work through accounts and keys that belong to you rather than to us — for example your own AI provider API keys, or, via our optional browser add-on, image generation through services you are already signed in to.
When you choose to do that:
- Your use of those services remains governed by their terms, not ours, and complying with them is your responsibility.
- You are responsible for any cost those providers charge you directly.
- We have no control over their availability. If a provider changes its interface, its pricing or its policies, a feature that depends on it may stop working, and that is not a failure of the Service under these Terms.
- API keys you supply are stored for your account and used only to carry out your own requests.
We provide these integrations as a convenience. We are not a party to your relationship with any third-party provider and cannot be responsible for what they do with your account.
9. Acceptable use
You agree not to use TubeMake to create or distribute:
- content that is illegal where you or your audience are, or that infringes someone else's copyright, trademark or other rights;
- sexual content involving minors, or any material that sexualises a real person without their consent;
- deepfakes or impersonations of real people or organisations intended to deceive;
- harassment, hate speech, incitement to violence, or targeted abuse of an individual;
- deliberate disinformation about elections, public health or ongoing emergencies;
- malware, phishing pages, scams or fraudulent commercial claims.
You also agree not to:
- resell, sublicense or white-label the Service without a written agreement with us;
- reverse engineer the Service, or attempt to extract prompts, models or source code from it;
- use automated means to create accounts, evade usage limits, or bypass metering;
- interfere with the Service's operation or with other users' access to it;
- probe or attack our infrastructure, other than through good-faith security research reported to us privately first.
10. Software on your device
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the TubeMake desktop application and browser add-on for as long as your account is in good standing. The software remains ours; this is a licence to use it, not a sale.
Rendering uses your own hardware. Performance depends on your machine, and we cannot guarantee any particular speed or output quality on it. You are responsible for backing up files stored locally on your device — we cannot recover them for you.
11. Availability and changes to the Service
We work to keep TubeMake available, but we do not promise uninterrupted service. Maintenance, outages at our providers, and faults all happen.
We may add, change or remove features. If we remove something significant that your paid plan relied on, and no comparable replacement is offered, you may ask for a pro-rata refund of the unused part of that plan period.
12. Suspension and termination
You can stop using TubeMake at any time and ask us to delete your account by emailing the address below.
We may suspend or terminate an account that breaches these Terms — in particular section 9 — or where we are required to by law. Where the circumstances allow it, we will warn you first and give you a chance to put things right. If we terminate a paid account for a reason that is not your breach, we will refund the unused part of the plan period.
After termination, we may delete the data associated with your account. Export anything you want to keep before you close it.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, that generated content will be accurate, original or suitable for your purpose, or that videos made with TubeMake will be approved, monetised or perform in any particular way on any platform. Nothing here excludes a right you have under mandatory consumer law that cannot be waived.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost data, lost channel earnings, or loss of goodwill, arising out of or relating to your use of the Service.
Our total aggregate liability for all claims relating to the Service is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim, or, if you have paid us nothing, to zero.
15. Indemnity
You agree to indemnify and hold us harmless against claims, damages and reasonable legal costs brought by a third party arising from content you created or published using the Service, from your breach of these Terms, or from your infringement of someone else's rights.
16. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law rules. Disputes will be brought before the competent courts of Vietnam.
Please contact us first. Almost everything is faster to resolve by email than by anything else, and we would rather fix the problem.
17. Changes to these Terms
We may update these Terms as the product changes. The "Last updated" date above always reflects the current version. If a change materially reduces your rights, we will notify account holders by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
